Definitions
Agreement - a public agreement for the use of the services of the Site.
Site - an Internet site with a domain name https://shurshur.com
The seller is FLP Savchuk Anna Vasilievna. Details and contacts are at the end of the Agreement.
Buyer - an individual, a visitor to the Site, who ordered the Goods for personal needs.
Order - a duly executed request of the Buyer for the purchase and delivery of the Goods.
Goods - stockings, hosiery products and accessories for them, offered for sale on the Site.
Article 1. General provisions
1.1. Acceptance of the terms of the Agreement is tantamount to an agreement signed between the Seller and the Buyer. By placing an order for the Goods, the Buyer accepts the terms and conditions for using the Site specified in the Agreement. If the Buyer does not agree with the terms and conditions, he is obliged to stop using the Site.
1.2. The provisions of the legislation of Ukraine apply to the relationship between the Buyer and the Seller. The Goods and the Agreement presented on the website are a public offer, in accordance with Articles 633 and 634 of the Civil Code of Ukraine.
1.3. The Seller has the right to amend the Agreement unilaterally by posting a new version of the Agreement on the Site without additional notice to the Buyer. The new version comes into force from the moment it is posted on the Site, unless otherwise provided in the Agreement.
1.4. The seller has the right to assign (or otherwise transfer his rights and obligations) to third parties.
1.5. The Site may be temporarily, partially or completely unavailable due to work or for any other technical reasons without notifying the Buyer.
1.6. If certain provisions or clauses of the Agreement are found invalid or illegal, then such provision may be excluded from the Agreement and replaced by a new provision. Moreover, such a replacement does not lead to a revision of the Agreement or the recognition of the entire Agreement as invalid.
Article 2. Goods
2.1. The Site offers goods for sale, including, but not limited to, stockings and accessories. In the absence of the Goods, the Seller has the right to exclude such Goods from the Order and notify the Buyer about this at the email address specified by the Buyer or by phone.
2.2. The Site contains basic information about the goods, as well as photographs. The photographs are illustrations of the Goods and may differ from the actual appearance of the Goods. The Seller may provide additional available information about the Goods at the request of the Buyer.
2.3. The Seller may unilaterally change the price of the Goods indicated on the Site. The right does not apply to the Goods ordered and already paid for, in accordance with the terms of the Agreement.
2.4. The price of goods that are delivered outside the territory of Ukraine does not include the payment of brokerage or customs fees, services or other fees established by the legislation of the country where the Goods are delivered.
Article 3. Order of Goods
3.1. The Buyer can place a request for the purchase and delivery of the Goods that are in stock and presented on the Site. The Seller sets the minimum order amount for the Goods and indicates it when placing an order by the Buyer.
3.2. Electronic ordering is carried out through the “Basket/Your order” on the Site. The Buyer, having received information about the Product on the Site, selects the Product at his own discretion, presses the "Buy/Order" button. In the “Basket/Your order”, the Buyer independently checks the correctness of the choice of the Goods, fills in information about himself, the delivery address, the delivery date and the method of payment, and places the order by clicking the “Order / Place an order” button.
3.3. The Buyer is fully responsible for the provision of false or inaccurate information, which entailed the impossibility of the Seller to properly fulfill its obligations to the Buyer.
3.4. In the event of a change in the price of the Goods, the Seller contacts the Buyer through the contacts indicated by him to confirm the order or cancel it. If it is impossible to contact the Buyer, the order may be considered canceled.
3.5. The order may be canceled by the Buyer by the time of payment and the actual transfer of the Goods if the Buyer does not receive the goods and does not pay for the Goods within the agreed period.
Article 4. Payment for the Goods
4.1. The price of the Goods is indicated in UAH on the terms of FCA (INCOTERMS 2010).
4.2. The price of the Goods does not include commission and additional fees of banks or payment systems. The buyer pays such fees on his own and at his own expense. The size of the commission or additional fee is reported by the relevant bank or payment system.
4.3. The price of the Goods may be changed by the Seller unilaterally on the terms specified in the Agreement.
4.4. Payment for the Goods is made in the form of 100% advance payment according to the details specified by the Seller.
4.5. The seller has the right to provide discounts on goods. Discount conditions are specified by the Seller and can be changed by the Seller unilaterally.
Article 5. Delivery of the Goods
5.1. Delivery of the Goods at the Buyer's choice is carried out by courier or postal service, including the Nova Poshta service, by courier delivery or delivery to the branch of the corresponding postal service.
5.2. The terms of delivery of the Goods in Ukraine should not exceed 5 working days, but in any case, the terms of delivery of the Goods, determined by the relevant postal service, are taken into account.
5.3. The cost of delivery is paid by the Buyer separately according to the tariffs of the corresponding postal service. The order of delivery and opening of the Goods is determined by the rules of postal communication established in the legislation of Ukraine and the corresponding postal service. The Seller has the right to independently pay for the delivery of the Goods to the Buyer when ordering the Goods for the appropriate amount. The amount of the order is determined by the Seller at its own discretion and is indicated when ordering.
5.4. Upon acceptance of the Goods, the Buyer inspects for compliance with the assortment, completeness and quality, and for the presence of defects on the packaging. In case of discrepancy, the Buyer may refuse the Goods only by drawing up an appropriate act with representatives of the postal service. In other cases, the return of the damaged Goods is made with the consent of the Seller. Return of the Goods for other reasons is carried out in accordance with the section Guarantees and return of the Goods in the Agreement.
5.5. The moment of transfer of ownership of the Goods is the moment of transfer of the Goods and the signature of the Buyer or the person specified in the Order as a recipient in the documents confirming the delivery of the Goods. At the time of transfer of ownership, the Seller is considered to have fulfilled its obligations under the Agreement.
5.6. Delivery of the Goods is a separate service that is not an integral part of the Goods. The purchase of the Goods with delivery does not give the right to demand delivery of the Goods during warranty service and / or replacement of the Goods and does not give the right to return the cost of delivery if there is a right to return the Goods.
5.7. When ordering outside of Ukraine (international delivery), the Seller (the seller's representative) contacts the Buyer and agrees on the possibility of such delivery, cost and time.
5.8. Goods ordered by the Buyer on the Site for international shipping may be subject to import taxes, duties, VAT and restrictions on importation into the receiving country specified by the Buyer. The presence of the above is the sole responsibility of the buyer. The Seller does not calculate on the Site and does not compensate for such expenses of the Buyer.
Article 6. Guarantees and return of the Goods
6.1. The Buyer has the right to refuse the Goods and terminate the Agreement within 14 (fourteen) calendar days from the date of receipt of the Goods, except for Goods that are not subject to exchange and return in accordance with the Decree of the Cabinet of Ministers N172 of 19.03.1994 "On the implementation of certain provisions of the Law of Ukraine "On the protection of consumer rights " with changes and additions. Such Goods include, including, but not exclusively, underwear.
Article 7. Confidentiality and personal data
7.1. The Seller collects and processes personal information that the Buyer provides independently during the Order in accordance with the Law of Ukraine dated June 01, 2010 No. 2297-VI "On the Protection of Personal Data" and the Agreement.
7.2. Personal data is collected and processed for the purpose of providing Buyers with access to the Site and processing Buyers' Orders, informing (including advertising materials), as well as other actions related to such purposes.
7.3. The Privacy and Personal Data Policy under the Agreement applies exclusively to the Site. When the Buyer goes to the websites of third parties (including third-party services), the Buyer is guided by the privacy policy of the corresponding service.
7.4. The Buyer indicates the surname and name, e-mail, phone number, delivery address of the Order. The rest of the information is provided by the Buyer at his choice in the comments to the Order. The buyer independently checks the accuracy of the information provided.
7.5. The Seller has the right to send advertising messages, promote the Goods, information materials regarding the Goods, the Seller's services, events and promotions.
7.6. The Seller has the right to transfer the personal data of the Buyers to third parties, if such transfer is required for the Seller to fulfill its obligations under the Agreement and protect the rights and freedoms of the Seller or third parties, if the Buyer violates the terms of the Agreement.
7.7. The Buyer has the right to refuse to receive advertising and other information by sending a message to the e-mail specified for contact on the Site. The Buyer has the right to request information about whether his data is being processed by the Seller. The seller provides such a response within 30 calendar days.
